User-Generated Content (UGC) - Image rights

1. Purpose

These General Terms and Conditions are intended to define the terms and conditions under which Volcom SAS is authorised to use, reproduce and distribute user-generated content (hereinafter the “UGC Content”) published on Instagram and identified, solicited or selected by Volcom SAS.

By responding positively to Volcom’s request (for example via a comment, private message or specific hashtag), you unreservedly accept these GTCs.

2. Definition of Content

The UGC Content includes, but is not limited to:

Photographs

Videos

Stories

Reels

Images featuring people, Volcom products, places or identifiable visual elements posted on Instagram by the user and selected by Volcom.

3. Authorisation and transfer of rights

By accepting these GTCs, you:

Expressly authorise Volcom, free of charge,

To use, reproduce, represent, adapt, modify, translate and distribute the UGC Content,

On any medium, including:

Volcom e-commerce sites,

product pages (PDP), editorial pages, lookbooks, newsletters,

marketing, advertising and promotional materials,

social networks, digital campaigns, CRM, marketplaces,

Throughout the world,

For the entire legal term of protection,

Without limitation as to number or territory,

Without financial compensation.

4. Image rights and represented persons

You guarantee that:

You are the author of the Content or have all of the rights needed in order to grant this authorisation,

All identifiable persons appearing in the Content (including yourself) have given their explicit consent to the use of their image,

The Content does not violate the privacy or rights of third parties (image rights, copyrights, trademarks, etc.).

5. Credit and mention of the author

In the absence of technical or editorial constraints, Volcom may mention your Instagram username as a credit when publishing the Content.

However, this mention is not mandatory and does not condition the use of the Content.

6. Removal of Content

You may request the removal of UGC Content by contacting Volcom at the following address: eu.service@volcom.eu

Volcom undertakes to examine the request within a reasonable period of time, without this affecting the legality of previous uses.

7. Liability

Volcom reserves the right to refuse or remove any UGC Content that is deemed inappropriate, contrary to the brand’s image or non-compliant with these GTCs, without justification or compensation.

8. Personal data

Any personal information associated with the UGC Content is treated in accordance with the Volcom Privacy Policy, which can be found on the official website.

9. Applicable law

These GTCs are governed by French law.

Any dispute relating to their interpretation or execution shall be subject to the jurisdiction of the French courts.
